St. Paul Ordered to Produce Reserves, Reinsurance Info in Late Notice Dispute With R&Q

PHILADELPHIA — A Pennsylvania federal judge has ordered St. Paul Fire and Marine Insurance Co. to produce documents concerning reserves and other reinsurance in a dispute over whether it promptly notified R&Q Reinsurance Co. of underlying asbestos claims.

In an Aug. 1 order, Judge Berle Schiller of the US. District Court for the Eastern District of Pennsylvania ruled that the information is relevant to the late notice dispute and is not privileged.

R&Q issued two facultative reinsurance certificates to St. Paul in the late 1970s and early 1980s pursuant to a Binding Authority Agreement (BAA). The facultative certificates, known as …
