Top’s, AUI Embroiled in Discovery Battle in Neb. Federal Promissory Note Action

OMAHA, Neb. — Top’s Personnel Inc. says Applied Underwriters Inc. has failed to comply with a court order requiring AUI to provide complete answers to Top’s interrogatories in a dispute involving sums allegedly owed AUI under a promissory note executed in connection with a reinsurance participation agreement.

In a June 28 motion to compel filed in the U.S. District Court for the District of Nebraska, Top’s seeks an order compelling AUI to produce supplementary initial disclosures and the deposition of AUI’s counsel, Jeffrey Silver. In addition, Top’s seeks sanctions in the form of expenses and attorneys’ fees.
