Plaintiffs Move to Dismiss Counterclaims in Berkshire Hathaway Reinsurance Fraud Action

NEW YORK — Plaintiffs accusing the members of the Berkshire Hathaway Group of carrying out a fraudulent workers’ compensation scheme involving a reinsurance participation agreement are seeking dismissal of counterclaims alleging that they failed to pay $2.7 million in premiums.
In a May 24 filing in the U.S. District Court for the Southern District of New York, the plaintiffs further maintain that defendants made material misrepresentations to the plaintiffs, insurance regulators, and the public at large as to material terms of the parties’ contracts, and therefore they should be rescinded and/or voided.
