Berkshire Hathaway Members Say Policyholders Owe $2.7 Million in Premiums Under RPA

NEW YORK — Members of the Berkshire Hathaway Group accused of carrying out a fraudulent workers’ compensation scheme involving a reinsurance participation agreement have asserted counterclaims of breach of contract against the plaintiffs, accusing them of failing to pay some $2.7 million in premiums.
In a May 4 filing in the U.S. District Court for the Southern District of New York, the defendants also asserted various affirmative defenses, including failure to state a claim, failure to mitigate damages, statute of limitations and/or laches, and failure to exhaust administrative remedies.
