Neb. Federal Judge Orders Applied Underwriters to Produce Discovery in Reinsurance Dispute

OMAHA, Neb. — A Nebraska federal judge has ordered Applied Underwriters Inc. to provide complete answers to Top’s Personnel Inc.’s interrogatories in a dispute involving sums allegedly owed AUI under a promissory note executed in connection with a reinsurance participation agreement.

In a March 31 order, Magistrate Judge Cheryl Zwart of the U.S. District Court for the District of Nebraska also ordered AUI to produce correspondence regarding the promissory note or RPA. However, the judge denied Top’s request to depose AUI’s counsel, ruling that it is not warranted at this time.
