OMAHA, Neb. — A Nebraska federal magistrate judge has agreed to reconsider her denial of Top’s Personnel Inc.’s motion to compel Applied Underwriters Inc. (AUI) to produce certain documents and discovery responses in a dispute involving a reinsurance participation agreement.

Magistrate Judge Cheryl R. Zwart of the U.S. District Court for the District of Nebraska granted Top’s motion on Feb. 1. Top’s argued that a Dec. 22 case management conference satisfied the requirement that the parties meet and confer before filing motions to compel discovery.
