Endurance Re Urges N.J. Federal Judge to Dismiss Chubb Trade Secrets Misappropriation Lawsuit

NEWARK, N.J. — Endurance Reinsurance Corporation of America and five other defendants have moved to dismiss Chubb INA Holdings Inc.’s lawsuit accusing them of misappropriating trade secrets, arguing that Chubb has failed to state claims under the Computer Fraud and Abuse Act and the Defend Trade Secrets Act.
In a Dec. 12 motion filed in the U.S. District Court for the District of New Jersey, defendants assert that Chubb’s former employees who left to work at Endurance were authorized to access the purported confidential information in the ordinary course of business and that the files were returned to Chubb.
