Texas Federal Judge Dismisses Tortious Interference Claims Against Resolute; Allows Celanese to Replead

DALLAS — A Texas federal judge has dismissed without prejudice Celanese Corp.’s claims accusing Resolute Management Corp. of wrongly denying coverage for underlying asbestos lawsuits in order to limit the reinsurance liability of its parent company, National Indemnity Co.
On May 20, Judge David Godbey of the U.S. District Court for the Northern District of Texas held that Celanese has not alleged facts giving rise to a plausible claim for declaratory judgment because Resolute is not a party to the underlying insurance contracts.
