CNA Calls Wausau’s Motion for Judicial Appointment of Umpire Premature, Baseless

MADISON, Wis. — Continental Casualty Co. has opposed Employers Insurance of Wausau’s motion for judicial appointment of an umpire to oversee an ongoing reinsurance arbitration, arguing that Wausau cannot challenge the alleged bias of CNA’s umpire candidates until after the arbitration award is entered.
In a May 12 opposition filed in the U.S. District Court for the Western District of Wisconsin, CNA further argues that there is no basis for judicial intervention because the reinsurance treaties at issue set forth a clear and specific process for appointing an umpire, and CNA has done everything to comply with the process.
