R&Q Asks Pa. Federal Judge to Dismiss St. Paul’s ‘Second-Filed’ Reinsurance Action

PHILADELPHIA — R&Q Reinsurance Co. seeks dismissal of a reinsurance action filed in Pennsylvania federal court by St. Paul Fire & Marine Insurance Co. so that the parties may proceed in a related “first-filed” action that had been transferred to Pennsylvania from Illinois.

St. Paul opposed the request, however, arguing to the U.S. District Court for the Eastern District of Pennsylvania that dismissal would bar it from seeking relief for its own affirmative claims that it asserted in the “second-filed” action.
