Applied Underwriters Amends Complaint Against Top’s Personnel, Omits Applied Risk as Co-Plaintiff

OMAHA — Applied Underwriters Captive Risk Assurance Company Inc. has filed an amended complaint against Top’s Personnel Inc., seeking $126,488.45 under a reinsurance participation agreement.

The March 3 pleading, filed in the U.S. District Court for the District of Nebraska, omits Applied Risk Services as a co-plaintiff, following a judge’s order directing Applied Risk to show that it is a real party in interest.

Applied Underwriters Captive Risk Assurance Company Inc. and Top's Personnel entered into an RPA on Dec. 14, 2011. Applied Risk Services was designated as the billing agent for both parties to the agreement.
