Breach of Contract, Unfair Trade Practices Claims Dismissed From Lawsuit Involving Formation of Captive Insurers

CHARLESTON, S.C. — A South Carolina federal judge has dismissed a breach of contract claim levied against an attorney in a dispute involving the formation of certain captive insurers, ruling that it is duplicative of the plaintiffs’ legal malpractice claim.

In the Feb. 12 order, Judge David C. Norton of the U.S. District Court for the District of South Carolina also dismissed plaintiffs’ unfair trade practices act claim, ruling that they failed to explain how the attorney’s advertising was false, deceptive, or misleading.
