Neb. Federal Judge Orders Applied Risk to Demonstrate Interest in Reinsurance Dispute

OMAHA, Neb. — A Nebraska federal judge has ordered Applied Risk Services Inc. to demonstrate why it is the real party in interest in a lawsuit seeking sums allegedly due a reinsurance participation agreement (RPA).

On Feb. 17, Judge John M. Gerrard of the U.S. District Court for the District of Nebraska found Applied Risk has so far failed to establish that it has a right or interest in the action.

Applied Underwriters Captive Risk Assurance Company Inc. and Top's Personnel entered into an RPA dated Dec. 14, 2011. Applied Risk Services was designated as the billing agent for both …
