Federal Judge Refuses to Modify Protective Order Shielding Arbitration Documents from Disclosure

WASHINGTON, D.C. — Counsel for a reinsurer that was engaged in a London arbitration against a defense contractor’s captive insurer cannot use documents produced by the U.S. Navy pursuant to an agreed protective order in a separate qui tam action filed against the defense contractor, a federal judge has ruled.

Judge James E. Boasberg of the U.S. District Court for the District of Columbia held that the terms of the protective order cannot be modified because the attorney was not a party to the order and did not show good cause for modification.
