Golden Isles Opposes Canal Insurance Co.’s Removal of $11.3 Million Georgia Reinsurance Action

ATLANTA — Golden Isles Insurance Co. has opposed a cedent’s motion to remand an $11.3 million reinsurance fraud action, arguing that there is complete diversity between the parties and the jurisdictional threshold has been met because the amount in controversy exceeds $75,000.
In its Nov. 9 opposition filed in the U.S. District Court for the Northern District of Georgia, Golden Isles further asserted that application of the discovery rule does not automatically mean that remand was proper and that it is for the court to decide whether a non-forum defendant properly removed the action.
