DENVER — A Chinese corporation has waived its right to arbitrate a contract dispute a second time by failing to pay its arbitration fees in the first arbitration which was ultimately dismissed, a Colorado federal magistrate judge has ruled.

On Sept. 22, Magistrate Judge Craig B. Shaffer of the U.S. District Court for the District of Colorado noted that the corporation ignored repeated warnings that the first arbitration would be dismissed if it didn’t pay its fees and it never indicated that it was unable to pay such fees.
