Munich Re Asks N.Y. Federal Court to Compel Utica to Produce Discovery in Limit of Liability Dispute

UTICA, N.Y. — Munich Reinsurance America Inc. has asked a New York federal court to compel Utica Mutual Insurance Co. to produce documents concerning whether all if its primary policies included an aggregate limit of liability, arguing that such information is relevant to whether Utica sought to maximize its reinsurance recovery for underlying asbestos liabilities.

In a Sept. 4 motion filed in the U.S. District Court for the Northern District of New York, Munich Re also seeks production of loss and expense reserves maintained by Utica and exposure analysis reports prepared by the insurer’s independent consultant.
