Conn. Federal Judge Dismisses Cal-Regent’s Counterclaim Against Odyssey Re in Commissions Dispute

BRIDGEPORT, Conn. — A Connecticut federal judge has dismissed a setoff counterclaim asserted by Cal-Regent Insurance Services Corp. against Odyssey Reinsurance Corp. in a dispute over $2.4 million in adjusted reinsurance commissions, ruling that it fails to state a claim upon which relief can be granted.
On Aug. 20, Judge Victor A. Bolden of the U.S. District Court for the District of Connecticut found the counterclaim arises from the parties’ reinsurance agreements, which are governed by Texas law. As such, the counterclaim should not have been brought under Connecticut law, the judge reasoned.
