N.M. Federal Judge Remands Insured’s Lawsuit Against NICO Subsidiary Resolute Management

ALBEQUERQUE, N.M. — A New Mexico federal judge has remanded to state court a policyholder’s lawsuit against its insurers and Resolute Management Inc., finding the plaintiff has asserted viable claims against Resolute.
On July 16, Judge Martha Vazquez of the U.S. District Court for the District of New Mexico noted that the plaintiff, United Nuclear Corp., has alleged that Resolute intentionally assisted or encouraged the insurers to breach insurance policies by helping them avoid paying UNC’s claims.
