N.Y. Federal Judge Will Consider Motion to Stay/Dismiss Limits of Liability Dispute

NEW YORK — A New York federal judge has scheduled a pretrial conference to address Munich Reinsurance America Inc.’s proposed motion to stay or dismiss a lawsuit filed by Continental Insurance Co. seeking $4.7 million in allocated loss and declaratory judgment expenses under the parties’ reinsurance certificate.
On July 13, Judge William H. Pauley III of the U.S. District Court for the Southern District of New York set the conference for Aug. 21. Munich Re asserts that the lawsuit is identical to the one it filed against Continental in Illinois state court and has no connection with New York.
