Texas Federal Judge Remands Case Accusing Resolute of Interference With Contract

DALLAS — A Texas federal judge has remanded a case in which Celanese Corp. accuses Resolute Management Inc. of delaying payment of claims submitted under liability policies issued by OneBeacon America Insurance Co. in order to relieve Resolute’s parent, National Indemnity Co., of having to pay reinsurance proceeds to OneBeacon.
On June 25, Judge Sam A. Lindsay of the U.S. District Court for the Northern District of Texas adopted a magistrate’s recommendation that the case be remanded because Celanese has asserted viable state law claims against nondiverse defendant Resolute.
