TAMPA, Fla. — A Florida federal judge has refused to dismiss First American Title Insurance Co.’s counterclaim of breach of the utmost duty of good faith against the reinsurer of a title insurance policy to the extent it relates to breach of the reinsurance contract at issue.
However, in the June 8 order, Judge James S. Moody Jr. of the U.S. District Court for the Middle District of Florida dismissed the counterclaim to the extent it does not relate to the reinsurer’s alleged breach of the contract.
