Texas Federal Magistrate Recommends Remand of Case Accusing Resolute of Interference With Contract

DALLAS — A Texas federal magistrate judge has recommended remand of a case in which Celanese Corp. has accused Resolute Management Inc. of delaying payment of claims submitted under liability policies issued by OneBeacon America Insurance Co. in order to relieve Resolute’s parent, National Indemnity Co., of having to pay reinsurance proceeds to OneBeacon.
On May 27, Magistrate Judge David L. Horan opined that Celanese has asserted viable state law claims against nondiverse defendant Resolute and, as such, Resolute was not fraudulently joined to the action.
