Excalibur Seeks to Enjoin Select Insurance From Proceeding With Connecticut Action

PHILADELPHIA — Excalibur Reinsurance Co. seeks to enjoin Select Insurance Co. from proceeding with a lawsuit involving retrocessional proceeds in Connecticut federal court, arguing that the “first-filed” rule requires that the dispute be heard in Pennsylvania.
In a May 18 request for an order to show cause filed in the U.S. District Court for the Eastern District of Pennsylvania, Excalibur asserts that because it filed suit first, Select should not be allowed to proceed with the Connecticut action, which involves the same parties, contract and issues.
