DENVER — A Colorado federal judge has denied insurers’ motion for a protective order in a coverage action, ruling that 30(b)(6) deposition topics on reserve and reinsurance information are relevant at this stage in the action because the policy’s assignee’s bad faith claims are still pending.
However, in the April 14 order, Judge Nina Y. Wang of the U.S. District Court for the District of Colorado ruled that the reinsurers may interpose objections based on privilege. The judge further held that topics relating to the drafting, marketing, and underwriting of the policy and claims handling are relevant.
