TAMPA, Fla. — In response to First American Title Insurance Co.’s counterclaims of breach of contract and breach of utmost good faith, Old Republic National Title Insurance Co. asserts the cedent relinquished its right to demand payment under the parties’ reinsurance agreement prior to Jan. 21.
In an April 20 answer filed in the U.S. District Court for the Middle District of Florida, ORNTIC also asserts that FATICO’s counterclaims are barred by material misrepresentations it made in connection with the reinsurance agreement.
