Michigan Millers Ordered to Produce Communications With Reinsurance Consultant

GRAND RAPIDS, Mich. — A Michigan federal magistrate judge has ordered Michigan Millers Mutual Insurance Co. to produce certain communications with its reinsurance consultant, ruling that the information is relevant to its reinsurance dispute with Westport Insurance Corp.
In a March 24 order, Magistrate Judge Phillip J. Green of the U.S. District Court for the Southern District of Michigan rejected MMMIC’s argument that Westport is taking a “scorched earth” approach in its demand for documents.
Westport’s predecessor, Employers Reinsurance Corp., issued a reinsurance treaty to MMMIC, effective Jan. 1, 1998. The agreement covered business underwritten by MMMIC’s Agribusiness Department “including …
