Reinsurance Calculations Not Discoverable in Coverage Dispute, N.Y. Federal Magistrate Judge Rules

NEW YORK — A New York federal magistrate judge has ruled that plaintiffs in a pollution coverage case are not entitled to redacted information from “executive claim summaries” prepared by the insurer because the information does not concern reinsurance reserves, but rather reinsurance calculations that are irrelevant to the dispute.

In a March 2, Magistrate Judge Michael H. Dolinger of the U.S. District Court for the Southern District of New York also ruled that a memorandum prepared by an additional insured’s counsel that had been sent to the insurer’s counsel is protected by the work-product privilege.
