FATICO Urges Fla. Federal Court to Dismiss Negligence Claim in $3.8 Million Reinsurance Action

TAMPA, Fla. — First American Title Insurance Co. has asked a Florida federal court to dismiss a negligence claim asserted by Old Republic National Title Insurance Co. in its lawsuit demanding return of a $3.8 million reinsurance payment on the basis of fraud.

In its Feb. 11 motion to dismiss filed in the U.S. District Court for the Middle District of Florida, FATICO asserts that the negligence claim is in essence a breach of contract claim and cannot survive under West Virginia law.
