Munich Re Opposes Utica’s Motion to Remand $9.16 Million Reinsurance Action

ALBANY, N.Y. — Munich Reinsurance America Inc. is opposing Utica Mutual Insurance Co.’s motion to remand a $9.16 million reinsurance action, asserting that diversity jurisdiction exists because a state court has severed the claims against a non-diverse defendant.
In its opposition filed Feb. 17 in the U.S. District Court for the Northern District of New York, Munich Re argues that because non-diverse defendant Transatlantic Reinsurance Co. had been fraudulently misjoined, as the state court found, its citizenship should be disregarded.
