Utica Moves to Remand $9.16 Million Reinsurance Action to N.Y. State Court

ALBANY, N.Y. — Utica Mutual Insurance Co. has moved to remand its $9.16 million reinsurance action against Munich Reinsurance Inc., asserting that because it is currently appealing the severance of its claims against a non-diverse defendant, the federal court lacks jurisdiction.
In its motion filed Jan. 21 in the U.S. District Court for the Northern District of New York, Utica argues that this action can become removable only as a result of a voluntary action by the plaintiff, and not by a court ruling opposed by the plaintiff.
