OneBeacon, Resolute, Oppose Celanese’s Efforts to Remand Coverage Dispute to Texas State Court

DALLAS — A lawsuit accusing OneBeacon Insurance Co. and Resolute Management Inc. of delaying payment under policies issued to Celanese Corp. should remain in federal court because Celanese has no viable claim against the nondiverse defendant, defendants maintain.
In their Dec. 22 opposition to Celanese’s motion to remand the action, OneBeacon and Resolute maintain that the case was properly removed to the U.S. District Court for the Northern District of Texas because Celanese is collaterally estopped from pursuing its claim of tortious interference with contract against Resolute.
