Mass. Federal Judge Compels Arbitration of ‘Access to Records’ Reinsurance Dispute

BOSTON — A Massachusetts federal judge has granted a reinsurer’s motion to compel arbitration of a dispute regarding six reinsurance claims submitted by Liberty Mutual Insurance Co., finding an earlier arbitration award addressing the applicability of the reinsurance treaties’ “access to records” provision did not apply to these claims.
However, in the Nov. 6 order, Chief Judge Patti B. Saris of the U.S. District Court for the District of Massachusetts denied the motion to compel to the extent the arbitration award requires the reinsurer to make a coverage determination within 60 days of a claim submission.
