ST. LOUIS — A Missouri federal judge has refused to reconsider his order quashing a subpoena of an unissued reinsurance arbitration award, ruling that the movant has not demonstrated “exceptional circumstances” warranting the correction of any error.
Senior Judge E. Richard Webber of the U.S. District Court for the Eastern District of Missouri found the motion for reconsideration “raises only issues of law that previously were considered, ruled upon, and rejected by this court.” Because the motion is not based on "judicial inadvertence," it cannot be characterized as a Rule 60(b)(1) motion, the judge concluded.
