Wis. Federal Judge Awards Wausau Summary Judgment on Breach of Contract Claim Against R&Q

MADISON, Wis. — A Wisconsin federal judge has denied R&Q Reinsurance Co.’s request to reconsider her ruling allowing Employers Insurance Company of Wausau to combine indemnity and defense expenses in order to meet its retention under a reinsurance certificate.

In a July 28 order, Judge Barbara B. Crabb of the U.S. District Court for the Western District of Wisconsin also ruled that R&Q breached the reinsurance agreement at issue by failing to pay Wausau $694,492.27. However, the judge denied Wausau’s request for prejudgment interest, noting genuine disputes remain as to the sum to which Wausau is entitled.
