Umpire’s Failure to Disclose Medical Condition Does Not Warrant Vacatur of Award, N.Y. Judge Rules

NEW YORK — A New York federal judge has confirmed an arbitration award rendered in a maritime case, ruling that the umpire’s failure to disclose a serious medical condition did not constitute “corruption” or “misconduct” under the Federal Arbitration Act.

On June 30, Judge William H. Pauley III of the U.S. District Court for the Southern District of New York further held that the arbitrators did not manifestly disregard the law in interpreting the evidence required under the act governing the dispute.
