Minn. Federal Judge Orders Insurers to Produce Reinsurance Communications in Coverage Dispute

MINNEAPOLIS — A magistrate’s order requiring insurers to produce reinsurance communications in a coverage dispute was not clearly erroneous or contrary to law given the courts’ split on whether such communications are discoverable, a Minnesota federal judge has ruled.

On June 24, Judge John R. Tunheim of the U.S. District Court for the District of Minnesota explained that many courts have held that reinsurance communications relevant and discoverable in cases where a party brings claims for bad faith against an insurer. But courts have also held that reinsurance communications are not discoverable, the judge noted.
