OKLAHOMA CITY — An arbitration panel did not exceed its powers in determining that a subcontractor was not properly licensed under state law and is therefore not entitled to compensation for work it performed on a solar panel project, a federal appeals court has ruled in upholding a lower court’s confirmation of the award.
On June 19, the 10th Circuit U.S. Court of Appeals found the licensing issue fell within the parties’ broad arbitration clause, therefore the arbitration panel was authorized to consider that issue.
