Ohio Federal Judge Allows Plaintiff to Add RICO Claims in Mortgage Reinsurance Kickback Case

COLUMBUS, Ohio — An Ohio federal magistrate judge has allowed a plaintiff to add Racketeer Influenced and Corrupt Organizations Act claims to her class action complaint against PNC Bank N.A., in which she accuses the bank of engaging in a mortgage reinsurance kickback scheme.
On May 12, Magistrate Judge Terence P. Kemp of the U.S. District Court for the Southern District of Ohio held that the plaintiff’s delay in adding the RICO claims was not “undue” and does not prejudice the defendants. The judge also allowed the plaintiff to bring RICO claims against Assurant Inc.
