Nevada Federal Judge Dismisses Dispute Over Self-Insured Retention, Deeming it ‘Unripe’

RENO, Nevada — A Nevada federal judge has dismissed a suit filed by the Insurance Company of the State of Pennsylvania against Gemini Insurance Co. involving coverage for construction defects, finding the case is unripe because no demands have been made under the excess policy.
On April 17, Judge Robert C. Jones of the U.S. District Court for the District of Nevada explained that there is no live controversy as to the interpretation of a putative reinsurance contract between ICSOP and Gemini.
