Kan. Federal Judge Orders Production of Documents in Multi-Million Coverage Case

TOPEKA, Kan. — Documents withheld by Black & Veatch Corp.’s insurance broker in a coverage dispute involving power plant defects are not protected under the work-product doctrine because B&V failed to show that the withheld documents were prepared in anticipation of litigation.
On Feb. 28, Magistrate Judge K. Gary Sebelius of the U.S. District Court for the District of Kansas further ruled that the documents do not fall within the attorney-client privilege because B&V failed to show that they were made in confidence for the primary purpose of obtaining legal advice from a professional legal advisor.
