NEW YORK — National Casualty Insurance Co. has asked a New York federal court to dismiss or transfer to Massachusetts federal court First State Insurance Co.’s motion to confirm a Dec. 13 arbitration award which resolved contract interpretation issues.
In its motion to dismiss, National Casualty asserts that First State should have filed its petition in the U.S. District Court for the District of Massachusetts so it can be consolidated with an already-pending action arising out of the same underlying arbitration.
