Old Republic Must Reimburse MCCA For Sums Paid by Insurers, Mich Federal Judge Rules

DETROIT — A Michigan federal judge has ruled that Old Republic Insurance Co. is required to reimburse the Michigan Catastrophic Claims Association for sums the insurer receives from its insureds where the insureds must share financial responsibility for the claim.

In a March 26 order, Judge Denise P. Hood of the U.S. District Court for the Eastern District of Michigan explained that the MCCA must reimburse its member insurers, like Old Republic, for no-fault personal injury protection paid in excess of the statutory threshold, but the members must then pay the association sums they receive from their policyholders.
