NEW YORK — An Argentine reinsurer is immune from liability under the Foreign Sovereign Immunities Act for malicious prosecution claims brought against it in a United States court by its former counsel, a New York federal judge has ruled.
Judge Laura T. Swain of the U.S. District Court for the Southern District of New York found the FSIA’s commercial activity exception provisions provide no basis for the exercise of subject matter jurisdiction because the activity complained of occurred in Argentina.
