Judge Denies Utica’s Request for Preliminary Injunction in Confidentiality Agreement Dispute

UTICA, N.Y. — A New York federal judge has denied Utica Mutual Insurance Co.’s motion for a preliminary injunction enjoining R&Q Reinsurance Co. from disclosing allegedly confidential information in a separate reinsurance dispute involving a third party.

Judge David N. Hurd of the U.S. District Court for the Northern District of New York adopted a magistrate judge’s findings that Utica failed to demonstrate that the alleged breach of confidentiality would cause it irreparable harm. The judge did note, however, that Utica showed a likelihood of success on the merits of its claim that the confidentiality agreements had been breached.
