TRENTON, N.J. — A New Jersey federal magistrate judge has quashed subpoenas served upon Everest Reinsurance Co. by AIG in a coverage action filed by the Centrix Financial Liquidating Trust, ruling that as a non-party, Everest is shielded from discovery.
On Dec. 18, Magistrate Judge Tonianne J. Bongiovanni further found that Centrix has already produced the communications sought by AIG, therefore production by Everest would be duplicative.
Centrix Financial LLC filed for bankruptcy protection in the U.S. Bankruptcy Court for the District of Colorado. In March 2007, Everest filed an adversary proceeding against Centrix, alleging that its officers had defrauded …
