California Has No Personal Jurisdiction Over XL Bermuda, Court Affirms

LOS ANGELES — A California appellate court has affirmed a grant of XL Insurance (Bermuda) Ltd.(NYSE: XL)’s motion to quash service of a summons and complaint for lack of personal jurisdiction, ruling that the insurer has no “substantial, continuous or systematic” activities in California sufficient to confer general or specific jurisdiction.
On Oct. 5, the California Court of Appeal, 2nd District, ruled that the insurer’s participation in a quota share reinsurance contract does not constitute “extensive, wide-ranging and systematic contact such that it takes the place of physical presence in the form as a basis for jurisdiction.”
