Repwest Must Arbitrate Claims Against Praetorian, Federal Judge Rules

PHOENIX – An Arizona federal judge has ordered Repwest Insurance Co. to arbitrate claims alleging that Praetorian Insurance Co. breached two reinsurance agreements by entering into a 1999 commutation with another reinsurer without Repwest’s consent.

On Aug. 28, Judge James Tielborg of the U.S. District Court for the District of Arizona ruled that the claims for breach of contract and breach of the duty of good faith and fair dealing arise from the reinsurance agreements, which contained an arbitration clause.
