ST. LOUIS — A Missouri federal judge has denied a Lloyd’s syndicate’s motion to compel arbitration of a claim arising from the breach of a hydropower plant's reservoir wall, ruling that the policy’s arbitration clause conflicts with an endorsement requiring the parties to submit to the jurisdiction of Missouri courts.
On Aug. 23, Judge Jean C. Hamilton of the U.S. District Court for the Eastern District of Missouri concluded that the plain language of the policy suggests that the parties did not intend to submit disputes related to the policy to arbitration.
