NEW YORK - Antitrust claims brought by Global Reinsurance Corp. against Equitas Ltd. under New York's Donnelly Act fail because neither the New York act nor its federal equivalent can be read to extend to foreign conduct, New York's highest court has ruled. Global Reinsurance Corp. v. Equitas Ltd., No. 02251 (N.Y. App. Ct.).
In a March 27 opinion by Chief Judge Jonathan Lippman, the New York Court of Appeal found nothing in the complaint to justify an inference that the alleged conspiracy targeted United States commerce specially.
